What is classed as “personal data”?

  • for the operations, managment, security or administration of the Company and,

Our lawful basis for the processing of your data

“Processing is necessary for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract” Article 6(1)(b) GDPR

In accordance with Article 6(1)(b) GDPR we will process your information in order to perform a contract with you, which will include (but is not limited to);

  • Taking steps at your request prior to entering into a contract
  • Deciding whether to enter into a contract
  • Managing and performing the contract
  • Ensuring our records remain relevant

Disclosure

Wintech shall not pass on your personal data to third parties, without first obtaining your consent.

Who gets to view your data?

Your data is only accessible to Wintech employees. Any data of a sensitive nature (such as bank details) is handled in strictest confidence and by a limited number of employees only (such as those working in the accounts department).

Is your data sent to any third parties?

We may use your personal details in order to conduct identity checks as required by law, as a measure to prevent money laundering. The personal data we have collected from you at application, or any stage may be shared with fraud prevention agencies. We are required by law to review transactions and report any which may be suspected of being related to money laundering activities.

How long will your data be kept for?

We will retain your data from the enquiry stage as long as necessary to deal with your query, to the expiry of the period of Professional Indemnity Insurance, based on our legal and regulatory requirements.

Is our data processing statutory or contractual?

Our data processing is contractual, as per our terms and conditions.

Your rights

Under the GDPR, the following rights are guaranteed to individuals:

  • Access: You have a right confirm that your data is being processed and to access the personal data and other supplementary data we hold for you.
  • Correction: You have a right to request alterations to personal data you believe to be inaccurate.
  • Erasure: You have a right to request personal data is erased permanently.
  • Objection: You have the right to object to the processing of your personal data.
  • Restriction: In certain circumstances, you have the right to ask for your personal data to be restricted, which will ensure your data is stored by the Company, but not used.
  • Informed: You have the right to be informed about the collection and use of your personal information.
  • Data Portability: You have the right to obtain and reuse your personal data, for your own use across different services.
  • Automated decision making (including profiling): The GDPR includes provisions about automated decision making and profiling, which gives individuals rights. Wintech does not use automated decision making or profiling techniques.

Should you wish to exercise any of the above rights, please submit a request (verbally or in writing) to Natasha Haywood (HR Director), who will respond to your request within thirty days. If requests are denied, full detailed explanations shall be given in writing to you, and it shall outline any appeal processes that are available to you.

How Do We Protect Your Data?

We implement appropriate technical and organisational safeguards to protect against unauthorised or unlawful processing of personal data and against accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to personal data. Please be advised, however, that we cannot fully eliminate security risks associated with the storage and transmission of Personal Data.
